The short version

  • We provide OpsMerge as a SaaS platform. You use it under these terms.
  • During open beta, every account starts with a 90-day free trial; paid subscriptions thereafter are charged at the published prices less any promotional discount applied at checkout.
  • We don't sell your data. We don't share it with third parties beyond named sub-processors (see Privacy Policy).
  • You can export your data at any time. We will not hold it hostage.
  • Either party can terminate during beta with no penalty. Notice periods apply post-GA.
  • UK law applies. UK courts have jurisdiction.

1. Agreement

By accessing or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

2. Subscription

Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. You may cancel at any time from your account settings; cancellations take effect at the end of the current billing period. During open beta, the Service is free for the 90-day trial period; promotional discounts (such as the open-beta code) apply for the period stated at checkout and then revert to the published price.

3. Acceptable Use

You agree not to: (a) use the Service to violate any law; (b) attempt to reverse-engineer the Service; (c) resell the Service without written permission from Brindleford Technologies Ltd; (d) abuse rate limits or use automated tools to scrape data; (e) use the Service to transmit malware, spam, or any content that infringes third-party rights.

4. Data

You retain ownership of all data you submit to the Service. We process your data in accordance with our Privacy Policy. You are responsible for ensuring that your use of the Service complies with applicable data protection laws in your jurisdiction.

5. Device Management

If you enrol devices into the Service's mobile device management (MDM) features, you authorise Brindleford Technologies Ltd to manage those devices on your behalf, including applying configuration policies, installing and removing applications, issuing device commands (such as lock, locate, or wipe), and collecting device state, using Google's Android Management API.

You confirm that: (a) you own each enrolled device or are authorised by its owner to manage it; (b) you have informed the people who use enrolled devices that the devices are managed and what data is collected, as required by applicable law; and (c) applications force-installed on enrolled devices are selected by you or your administrators through the policies you configure. Device management features must not be used for unlawful monitoring of individuals.

6. Termination

We may suspend or terminate accounts that violate these Terms. You may terminate your subscription at any time; see section 2 for the effect of cancellation on billing.

7. Liability

To the maximum extent permitted by applicable law, the aggregate liability of Brindleford Technologies Ltd for any claim arising from your use of the Service is limited to the fees paid by you to us in the 12 months preceding the claim.

We do not warrant that the Service will be uninterrupted or error-free. The Service is provided "as is" without warranty of any kind, express or implied.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
